Different Legal Action For Publishing Scandal Issue Over Different Region

As the wild wide circulation of Edison Chen scandal pictures and clips started, several entertainment channels have made money by publishing and reporting of the special issue. Recent source has reported that a mainland Chinese entertainment magazine also published the scandal with 30 of the photos as follow footsteps of Hong Kong Next Magazine and Oriental Sunday.

According to Mingpao, laser disc of the scandal pictures are on sale for HKD 40 in Canada. It is reported that the cost of the disc is only one tenth of the sales price.

Can you tell the difference? There is a total different legal action for pornography distribution in Hong Kong and Canada. As according to Article 170 of the Criminal Law Code of the People's Republic of China, the production and distribution of pornographic material for profit is subject to a maximum penalty of three years in jail plus fines. However, according to local lawyer in Canada, it is not unlawful to sell these laser discs while action is only to be taken after receiving complaint about violation of intellectual property rights.

No doubt that selling or distribution of explicit materials is strictly forbidded by the law. However, i will bet the legal team has faced a hard time take further action against the recent wide distribution of Edison scandal by different channels; publishing media and the personal internet user or netizens. Too many people out there are forwarding and sending the scandal mail with photo attachment. So, how should the legal team take action to it? Minority group of doing the same mistake is considered as illegal. However, would it still called as a crime if everyone (majority) is doing the same "crime" and the legal force has to arrest and fine everyone out there? So good, lock up all people to jail!!! Just kidding.
